Persistent failures identified in firms' legionella control measures

Following an investigation into the circumstances surrounding the death of an employee of a car parts manufacturer from legionnaires' disease, his employer and a water treatment company have been fined for breaching health and safety legislation. The Health and Safety Executive investigation into the man's death did not find sufficient evidence to allege any link between the activity undertaken by his employer, multinational manufacturing company Eaton Ltd, and the cause of his death, however it did find evidence to demonstrate that both Eaton Ltd and Aegis Ltd, the company contracted to provide water treatment services at Eaton's premises in Brierley Hill, West Midlands, had failed to "take such steps as were reasonably practicable to control the risk of the spread of legionella bacteria".
