New Mexico has filed a lawsuit seeking an injunction halting US Nuclear Regulatory Commission activities to license a proposed dry spent fuel storage facility, alleging that NRC is acting outside its authority under federal law and ignoring state and local views. Holtec International applied to NRC in March 2017 for a license to store up to 8,680 mtU of US utility spent fuel, contained in about 500 of the company's storage casks, for an initial period of 40 years at a consolidated interim storage facility, or CISF, to be constructed in Lea County, New Mexico. Filed March 29 in the US District Court for the District of New Mexico, the lawsuit said NRC violated the Nuclear Waste Policy Act and the agency's own National Environmental Protection Act procedures by accepting for review a proposed facility that is not identified in NWPA, the Atomic Energy Act or other laws and agency regulations.
