An aslb has ruled on areas of litigable controversy in Aerotest Operations and Nuclear Labyrinth's dispute with the Nuclear Regulatory Commission staff regarding the companies' Aerotest Radiography and Research Reactor license transfer application (NN, May 2014, p. 52), which was denied by the NRC staff in July 2013 on the grounds that neither firm met the financial qualification requirements. In a May 22 memorandum and order, the presiding Atomic Safety and Licensing Board identified two litigable areas: "whether the staff correctly determined that the companies failed to demonstrate that they possess, or have reasonable assurance of obtaining the funds necessary to cover estimated operating costs for the period of the license," and "whether the staff correctly determined that the companies failed to provide reasonable assurance that they had sufficient funds to cover the annual costs for storing spent fuel until [the Department of Energy] accepts the fuel." Aerotest Operations and Nuclear Labyrinth may also challenge the reasoning behind the staff's determinations, the ASLB said.
