Zulassungsdauer von Pflanzenschutzmitteln: Fälle kürzer als zehn Jahre befristeter Zulassungen

The authorization of plant protection products is principally limited to ten years. In particular cases, a shorter period may be agreed upon. Shorter periods of authorization are either explicitly addressed by the German plant protection law or must comply with the requirements of Art. 16 para. 1 sentence 2 of the German plant protection law. Certain cases, in which the documents required for an authorization are incomplete, are not covered by Art. 16 para. 1 sentence 2 of the German plant protection law accordingly to the ruling of the VG Braunschweig. These cases are therefore no sufficient reason for an authorization less than ten years, provided that the documents concerned are of less significance.%Die Zulassungsdauer für Pflanzenschutzmittel beträgt grundsätzlich zehn Jahre. Kürzer als auf zehn Jahre befristete Zulassungen werden entweder ausdrücklich im Pflanzenschutzgesetz genannt oder müssen den Anforderungen des § 16 Abs. l Satz 2 des Pflanzenschutzgesetzes entsprechen. Fälle, in denen noch Zulassungsunterlagen ausstehen, werden allerdings nach der Rechtsprechung des VG Braunschweig nicht von dieser Vorschrift erfasst. Sie sind somit kein hinreichender Grund für eine kürzer als auf zehn Jahre befristete Zulassung, sofern Unterlagen von untergeordneter Bedeutung in Rede stehen.
