UNISON is very disappointed in the Court of Appeal judgment relating to sleep-in shifts and national minimum wage payment, reported in The MJ. Though the wider implications remain to be seen, we believe this is a decision that can be challenged.Receiving the minimum wage doesn't seem much to ask for care workers who are required to be in a place of work, have significant caring responsibilities, and would be disciplined if they left their post. Care staff who do such crucial work for the elderly and vulnerable deserve at the very least a basic wage. Sadly this situation is yet another symptom of a chronically underfunded care sector, and poor enforcement of minimum wage laws.The continuation of poverty wages and exploitative employment practices will only damage the care sector further. This judgment could potentially make it even more difficult to employ people in vitally important caring roles.
