As many council workers head off to the summer sun, their employers face the potential of crippling holiday pay claims. Following the recent judgement of the European court in 'Williams v British Airways pic', the TUC maintains that all employees are entitled to fair holiday pay, and the unions seem determined to raise these historic claims, some going back as far as 1996 in the upcoming pay negotiations.The issue has arisen following holiday pay claims made by several thousand pilots. They argued successfully that their holiday pay should be based not on their basic wage, but include a genuine calculation of what they would have been paid if they had worked those days. So this must include allowances, overtime and 'perks'. Because the Working Time Regulations come from an EU directive, this could hit employers with liabilities stretching back as far as 23 November 1996 - the date that the directive should have been implemented in the UK. How has this situation arisen?
