Attorney General's Report: Using Pseudoephedrine Sales Records To Build A Meth Lab Case

In 2005, the Minnesota Legislature enacted regulations on over-the-counter sales of ephedrine and pseudoephedrine, readily available precursors in the manufacture of methamphetamine. The laws provide an important investigative tool to locate meth labs and prosecute those who try to manufacture methamphetamine in our communities.rnThe basics of the statute. The basic provisions of the laws covering over-the-counter sales of ephedrine and pseudoephedrine are set forth in Minnesota Statutes § 152.02, subdivision 6. A "methampheta-rnmine precursor drug" is defined as "any compound, mixture, or preparation intended for human consumption containing ephedrine or pseudoephedrine as its sole active ingredient or as one of its active ingredients." An "over-the-counter sale" is defined as "a retail sale of a drug or product but does not include the sale of a drug or product pursuant to the terms of a valid prescription."
