Recently courts in the US have set fines around the several million US$ mark for one off incidences. And earlier this year, to further exercise its might, the United States Court of Appeals for Second Circuit confirmed that US Courts have a wide jurisdiction over foreign flag vessels, even if no discharge has taken place and no incorrect entries have been made while in US waters. US Courts can now prosecute owners based on production of an oily record book (ORB) which contains inaccurate entries, even if those entries were made outside US waters.
