States Sue EPA Over 2020 MACT Rule; Biden-Era EPA to Change Course on Environment

In January, several states filed a petition to sue the U.S. Environmental Protection Agency (EPA) over its October 2020 Major Maximum Achievable Control Technology (MACT) to Area Rule (referred to as “MM2A”), which codified the end of its “Once In, Always In” policy pertaining to major source MACT applicability. The next day, shortly after his inauguration on January 20, President Biden issued an executive order representing the first step in what promises to be a broad reversal in course by EPA on several important issues concerning both air pollution and climate change.
