HathiTrust Digitization Project Ruled Fair Use

In a ruling that could set new precedents for copyright law in the digital age, U.S. District judge Harold Baer Jr. on October 10 held that HathiTrust's mass digitization is fair use, in spite of the challenges raised in a lawsuit by the Authors Guild and others. Crucial to his reading of the case is Baer's rejection of the plaintiff's theory that section 108 of the copyright law prevents libraries from claiming fair use as a defense.
