The appeal was made under the Town and Country Planning Act 1990 s.78 against a failure to give notice within the prescribed period of a decision on an application for outline planning permission. The proposed development was the demolition of existing agricultural shed buildings, residential development of up to 370 dwellings (Use Class C3), a flexible use building falling within use class D1, public open space, accesses onto Gloucester Road, and associated infrastructure.
