The appellant owned land at No.221 Archway Road, London. He also had an interest in land at No.223 Archway Road. He owned No.221 in conjunction with his wife and owned No.223 outright. There were former garages at the rear of No.223 and at the rear of No.221 were former garages and a workshop. During the course of the proceedings in respect of the second enforcement notice, the appellant made certain representations to the Inspector that there had been a workshop structure at the rear of No.221 in the past and at the rear of No.223 had been some garages. There was constructed at the rear of No.221 a dwelling. This dwelling had been erected without the benefit of planning permission.
