The appellant developer (X) appealed against a decision {Kensington and Chelsea RBC v Secretary of State for Communities and Local Government [2010] EWHC 1092 (Admin)) quashing the decision of the second respondent Secretary of State's inspector granting planning permission in respect of a development of residential units. X had applied for planning permission to convert a London hotel into nine self-contained residential units. The site was subject to planning guidance which set a target whereby 50 per cent of all additional housing should be "affordable". As X had not made any proposal for affordable housing on the site, the inspector conducted an inquiry as to whether X was obliged to provide such housing.
