The applicant developer (W) applied to quash a decision of the respondent Secretary of State to refuse to grant it outline planning permission for a housing development. W's development proposal was for one of the largest housing applications ever made in Cornwall and would increase the housing stock of the St Austell area by about 10 per cent. The local authority failed to determine the application and W appealed. The local authority contested it on grounds including the lack of need for such a large development in advance of the preparation of the local authority's core strategy for Cornwall. The inspector concluded that there was a five-year supply of housing land and no pressing need for the proposed housing, the proposed development was contrary to the development plan and the size of the development meant that the grant of planning permission would prejudice decisions addressed in the emerging Cornwall core strategy.
