In an Opinion by the Advocate General, several ghosts finally have been put to rest in a ferocious 30-year jockeying for position between brand owners and European importers over the ability of importers to replace existing brand owner trade marks with the importer's own brand names (ie repackaging) for purposes of the European market harmonization.
