Bad faith and false representation of infringement

The Ninth Circuit now requires that a plaintiff establish bad faith on the part of a patentee or its agents in order to bring Lanham Act or state law claims premised on allegedly false representations of patent infringement made in an earlier unsuccessful patent infringement suit.
