Federal Motor Carrier Safety Administration Publishes Revised '3 STRIKES' Policy

The Federal Motor Carrier Safety Administration (FMCSA) published a clarification of the agency policy concerning implementation of provisions of Section 222 of the Motor Carrier Safety Improvement Act of 1999 (MCSIA), PL 106-159 in the federal register at 69 FR77828 dated December 28, 2004. Section 222 requires the agency to assess maximum statutory penalties if a person is found to have committed a pattern of violations of acute or critical violations, or committed same or related violations of acute or critical regulations. These acute and critical violations are found in Appendix B, 49 CFR Part 385.
