DOT Emergency Restriction/Prohibition Order Expanded and Clarified

On March 6, 2014, the Department of Transportation (DOT) issued an amended and restated emergency restriction/prohibition order (Amended Order) which supersedes and replaces the one issued by Secretary of Transportation Anthony R. Foxx on February 25, 2014. (See HazMat Alert 2014-10 at hazmatship.com for our review of the original order.) Major changes from the original order include prohibiting persons from reclassifying petroleum crude oil with the intent to circumvent the requirements of the amended order and simplifying and clarifying provisions addressing classification testing.
