WHAT TO DO WHEN THE H-1B NUMBERS RUN OUT: ALTERNATIVE APPROACHES TO EMPLOYING FOREIGN NATIONALS

Companies are scrambling to find alternative immigration approaches ever since the H-1B avenue was cut off in October 2004. Despite the fact that an additional 20,000 H-1Bs are to become available any day, these 20,000 visas are likely to be used up on the same day that filing is permitted given long pent up demand for H-1Bs. And we expect that the fiscal year 2006 annual quota of 65,000 (which become available October 1, 2005) will be exhausted shortly. If a company is not fortunate enough to secure one of these coveted H-1Bs, they should explore alternative visa solutions.
