As a signatory to the North American Free Trade Agreement with the United States and Mexico, Canada is bound to establish an antitrust regime. In fact, Canada has had some form of competition or antitrust law since 1889, when it brought in a law against "unduly" lessening competition. The primary current source of antitrust law in Canada is the Competition Act of 1986 (hereinafter "the Competition Act"). The Competition Act provides for both civil and criminal penalties, each involving separate enforcement procedures.
