European Union to Appeal WTO Ruling On Brazilian Ban on Retreaded Tires

Geneva—The European Union is expected to file an appeal against a World Trade Organization panel ruling that partially upheld an EU complaint against a Brazilian ban on imports of retreaded tires. Officials said the European Commission had informed Brazil of its intent to file an appeal. The EU is normally required to file an appeal by Aug. 12, but the two countries may agree to postpone that deadline to allow the Commission to file a formal notice of appeal in early September. In the ruling, which was circulated to the two parties April 23, the panel backed the European Union's claim that the Brazilian ban violates WTO rules prohibiting import restrictions and discriminatory treatment between imports and like domestic products. However, the panel went on to say that the ban could be justified as an exception to WTO rules based on public health concerns.
