Changzhou Trina Solar Energy Co. Ltd. and other solar firms in China failed to convince the Court of International Trade that an agency determination that paved the way for stiff duties on imports of solar cells and modules from China was unlawful (Changzhou Trina Solar Energy Co. v. Int'l Trade Comm'n, 2015 BL 270336, Ct. Int'l Trade, No. 13-00014, 8/7/15). The court in an Aug. 7 opinion, which was released Aug. 21, concluded that the International Trade Commission properly found that dumped and subsidized imports of solar cells and modules from China hurt the U.S. industry. Changzhou Trina Solar Energy Co. Ltd., Trina Solar (U.S.) Inc., Wuxi Suntech Power Co. Ltd., Suntech America Inc., Suntech Arizona, Inc., Yingli Green Energy Holding Co. Ltd., and Yingli Green Energy Americas Inc. challenged the ITC's final affirmative injury rulings anti-dumping and countervailing duty investigations on crystalline silicon photovoltaic (CSPV) cells and modules from China.
