JUDGE REJECTS DMCA TAKEDOWN OF BUGS BUNNY, POPEYE COMPILATION

Bugs Bunny and Popeye cartoons can once again be streamed on Amazon Prime after a Los Angeles federal judge ordered a video distributor to withdraw the takedown notices it filed under the Digital Millennium Copyright Act. U.S. District Judge Dale S. Fischer of the Central District of California on Aug. 14 granted music and video compiler Beyond Blond Productions LLC's motion for an order compelling ComedyMX Inc. to rescind the notices that blocked the online availability of the animated classics. Beyond Blond argued that the additions and changes ComedyMX made when creating DVDs of the cartoons, which have fallen in the public domain, failed to provide sufficient copyright protection. The plaintiff asked for an injunction against ComedyMX and its related entities for copyright misrepresentation under Section 512(f) of the DMCA, 17 U.S.C.A. § 512(f).
