On January 25, 2010, a federal district court in Kansas ruled that a lawsuit alleging Expedia Inc. ran a "bait and switch" marketing scheme must be filed in Texas, pursuant to a "clickwrap" forum-selection clause. See Fee v. Expedia, Inc., 2010 WL 265805 (Kan. Dist. Ct. 2010). The plaintiff sued Expedia, which operates the travel Web site Hotels, com, alleging that the site violated the state's Consumer Protection Act by unilaterally switching his paid reservation from a four-star hotel to a three-and-a-half star lodging.
