UNDER DISCOVERY RULE, COPYRIGHT OWNER SHOULD HAVE DISCOVERED DEFENDANTS' ALLEGED INFRINGEMENT

Under the discovery rule, a copyright owner, who had actual knowledge that defendants previously infringed on its rights to the copyrighted work and, after filing an action against defendants, resolved the action, and entered into licensing agreement, should have discovered the alleged copyright infringement when defendants released and distributed musical recordings in a manner exceeding the scope of the licenses.
