COMMERCIAL PRINTER DOES NOT 'USE' TRADEMARK UNDER THE TDRA BY REPRODUCING IT FOR CUSTOMERS AS PART OF ITS BUSINESS

Addressing an issue of first impression in the circuit, the Fifth Circuit has held that a com mercial printer does not "use" a trademark within meaning of the Trademark Dilution Revision Act when it reproduces or offers to reproduce the mark for customers as part of its printing business. See National Business Forms & Printing, Inc. v. Ford Motor Co., 101 U.S.P.Q.2d 1746, 2012 WL 502712 (5th Cir. 2012).
