(A) The patent applicant is as a matter of principle at liberty not to restrict the claimed protection to embodiments that are expressly described in the documents originally submitted but to make certain generalisations provided that this takes account of the justified interest in setting out the invention in full. (b) Whether the wording of a patent claim that contains a generalisation satisfies the requirement of an executable disclosure is determined according to whether the protection requested remains within the limits of what appears to the person skilled in the art as being the most general form of the technical teaching by means of which the problem underlying the invention is solved, taking into account the description and the embodiment examples it contains.
