On September 23, the Department of Labor announced its final rule updating the earnings thresholds necessaryto exempt executive, administrative, or professional employees from the FLSA’s minimum wage and overtimepay requirements. The DOL says that 1.3 million American workers will be newly eligible for overtime pay underthe rule. The final rule is effective on January 1, 2020.The DOL has updated both the minimum weekly standard salary level and the total annual compensationrequirement for “highly compensated employees” to reflect growth in wages and salaries. The new thresholdsaccount for growth in employee earnings since the currently enforced thresholds were set in 2004. The DOLbelieves that the update to the standard salary level will maintain the traditional purposes of the salary level testand will help employers more readily identify exempt employees. The DOL has also revised the special salarylevels for employees in U.S. territories and the special base rate for employees in the motion picture producingindustry.
