The U.S. Court of Appeals for the Ninth Circuit affirmed the dismissal of a Fair Housing Act reasonable accommodation claim involving a condominium association's no-pet policy. (Dubois v. Association of Apartment Owners of 2987 Kalakaua, No. 04-15695, 2006 WL 1916347 (9th.Cir (Hawaii)), July 13, 2006; for background, see Current Developments, Vol. 32, No. CD-3, p. 90.) The plaintiffs acquired a dog and argued that they needed the animal for medical reasons related to stress and depression. The association allowed the plaintiffs to keep the dog while the issue was being litigated, and in fact, they kept the animal until they vacated the unit. Because the association never refused to make the requested accommodation, the court said, the plaintiffs' Fair Housing Act claim failed.
