The U.S. Supreme Court has let stand a Fifth Circuit ruling that property owners suffering flood damage from Hurricane Katrina when levees broke can't recover losses under insurance policies with flood exclusions, even if negligence caused the breaks. The Court denied certio-rari in two of the four cases consolidated in the Katrina litigation.
