Exceptions to ARM Buy American Requirement Will Apply to Certain Projects Receiving Capital Funds

HUD has determined that certain exceptions to the Buy American requirements of the American Recovery and Reinvestment Act (ARRA) will apply to the $4 billion in public housing capital funds provided by the act.rnA notice describing the exceptions was published in the September 11 Federal Register.rnUnder Section 1605(a) of ARRA, if funds are used for the construction, alteration, maintenance, or repair of a public building or public work, all of the iron, steel, and manufactured goods used in the project must be produced in the United States.rnHowever, Section 1605(b) provides that the Buy American requirement won't apply in any case in which the head of a federal agency finds that applying the requirement would be inconsistent with the public interest; that iron, steel, and the relevant manufactured goods are not produced in this country in sufficient and reasonably available quantities or of satisfactory quality; or that inclusion of domestic iron, steel, and manufactured goods will increase the overall project cost by more than 25 percent.
