Reversing its previous decision, the U.S. Court of Appeals for the Ninth Circuit held that a local mobile home park rent control ordinance did not constitute a regulatory taking of the owner's property. Plaintiffs Daniel and Susan Guggenheim and Maureen H. Pierce (together, Guggenheims) acquired a mobile home park in 1997, when it was subject to a Santa Bar bara County, Calif., rent control ordinance (RCO). The ordinance was adopted by the city of Goleta when it was incorporated in 2002.
