PHA Can't Terminate Participation for Not Reporting Income Change Unless Failure to Report Was Intentional

A housing authority cannot terminate participation in the Section 8 voucher program because of a tenant's failure to report a change in family income unless the reporting failure was intentional, ruled the Ohio Court of Appeals, Second District, Greene County. (McClarty v. Greene Metropolitan Housing Authority, No. 2011-CA-30, 2011 WL 3890295 (Ohio App. 2 Dist.), September 2, 2011) Clarissa McClarty, a single mother of three children, participates in the voucher program administered by the Greene Metropolitan Housing Authority (GMHA). Because of McClarty's low income, GMHA's voucher pays her entire rent, and she also qualifies for Section 8 assistance for her utility bills.
