Villa Vicenza Homeowners Association v. Nobel Court Development, LLC, 2013 WL 178590 (Cal. App. 4th Dist. 2013), unpublishedoncitable, was a decision of the California Court of Appeals reversing the ruling of the lower court that found a condominium homeowners association, whose formation occurred after the recording of the complex's covenants, conditions, and restrictions (CC & Rs), was not bound by an arbitration clause in such CC & Rs with respect to construction defect claims against the developer.
