First Circuit Found No Substantial Federal Issue For Federal Question Jurisdiction In Puerto Rico Community Development Block Grant Claim

In an opinion delineating the boundaries of federal subject matter jurisdiction over state law claims, the First Circuit vacated and remanded a decision by the U.S. District Court for the District of Puerto Rico that a commonwealth law claim concerning the Community Development Block Grant Program ("CDBG") of the U.S. Department of Housing and Urban Development ("HUD"), 42 U.S.C.A. § 5301, arose under federal law for purposes of 28 U.S.C.A. § 1331. Municipality of Mayaguez v. Corporation Para el Desarrollo del Oeste, Inc., 2013 WL 4007986 (1st Cir. 2013).
