Long Canyon Phase Ⅱ and Phase Ⅲ Homeowners Association, Inc. v. Cashion, 2017 WL 875314, No. 03-15-00498 CV (Tex. App. Mar. 3, 2017), was a Texas Court of Appeals decision affirming a trial court decision granting a defendant homeowners' association's motion to dismiss under the Texas Citizens' Participation Act against plaintiff homeowners for alleged threatening statements contained in an association's presuit demand letter to homeowners which asserted that the plaintiffs violated an association landscaping covenant, where the letter was deemed by the court to be an exercise of the constitutional right to petition.
