The District of Columbia Court of Appeals ruled in Union Market Neighbors v. District of Columbia Zoning Commission,--A.3d--, 2019 WL 1388463, No. 17-AA-780 (D.C. App. Mar. 28, 2019) that the District's Zoning Commission properly reviewed and approved the application of a developer to construct a mixed-use planned unit development, where the Commission conducted a general first phase PUD review of the developer's affordable housing commitment in accordance with the zoning regulations, and issued an Order after the more stringent second phase PUD review which established stricter affordable housing requirements.
