GOOD FAITH PURCHASER

Cherry Community Organization v. Sellars, 2020 WL 774020 (Table) (Unpublished), No. COA19-695 (N.C. Ct. App. Feb. 18, 2020) was an unpublished decision by the North Carolina Court of Appeals finding that the developer who purchase a parcel for a mixed-use development in Charlotte was a good faith purchaser despite the intent of the seller's principal to hinder, delay or defraud the plaintiff community organization, from whom the seller originally bought the parcel. The court gave little weight to evidence of an agency relationship of the seller as agent which imputed knowledge of the seller's actual intent to the purchaser as principal.
