EPA Re-Examining RCRA Definition of Solid Waste Rule in Response to Petition

EPA published a final rule that revised the RCRA definition of solid waste to exclude certain hazardous secondary materials from Subtitle C regulation on October 30,2008 (73 FR 64668). In the rule, the agency defined hazardous secondary materials as those that would be classified as hazardous if discarded. The rule promulgated three principal regulatory pi ovisions:rn1. An exclusion for certain hazardous materials that are legitimately recycled under the control of the generator within the United States or its territories,rn2. A conditional exclusion for hazardous secondary materials that are transferred for the purpose of legitimate reclamation, andrn3. A case-by-case non-waste determination procedure.rnThe rule also promulgated regulatory factors for determining when recycling is legitimate. The final rule became effective December 29, 2008.
