Appeals Court Finds Property Seller Liable for RCRA Units, But Purchaser Assumed CERCLA Liability

The appeals court reversed in part, and affirmed in part, the district court's decision. The appeals court reversed the district court's grant of summary judgment to GenCorp, finding that GenCorp was liable under RCRA for the costs of closing the hazardous waste management units. However, the appeals court affirmed that Textileather is liable under CERCLA. Accordingly, the case was remanded to the district court for further consideration consistent with the appeals court's opinion.
