The Supreme Court today declined to take a case challenging Minnesota's "right-of-first-refusal" law for utilities.LSP Transmission Holdings LLC (LS Power) had turned to the high court last November in an effort to overturnwhat it called a "protectionist" 2012 law, which gave utilities that had an in-state presence priority in certainprojects.The electric utility had argued that the law violates the Constitution's "dormant" commerce clause by hinderinginterstate commerce.
