Telecom NZ's appeal against $NZ12m 'data tails' penalty backfires

The New Zealand Court of Appeal has upheld and expanded an earlier High Court judgement that imposed a $NZ12m fine on Telecom for unlawfully taking advantage of its market power to overcharge for wholesale access to its network.rnThe Court of Appeal also found additional breaches of the Act beyond those for which the $NZ12m penalty was imposed. It has yet to rule on penalties resulting for its judgement. The $NZ12mrnpenalty was the highest ever imposed under the Commerce Act, which was amended in 2001 to increase the fines available for anti-competitive conduct.
