Court says Austrian traffic prohibition illegal

The EU Court of Justice has once again declared illegal the traffic prohibition for lorries imposed by Austria on the A12 motorway, in the Inn valley (Tyrol), one of the principal routes between Southern Germany and Northern Italy. In a judgement handed down on 20 December 2011 (Case C-28/09), it holds that the measure "disproportionately" restricts the free movement of goods. Austria put the ban in place after establishing that the annual limit value for nitrogen dioxide (NO_2) set by EU legislation was exceeded on this motorway.
