Is New Zealand's Trade Marks Law Out of Shape?

In contrast to European trade mark law, New Zealand's Trade Marks Act 2002 does not prohibit the registration of certain shapes as trade marks on the grounds of public policy. It is argued that the decision to omit such a provision from New Zealand's trade mark legislation will force courts to wrestle with contentious issues of policy when dealing with infringement.
