Parties Reach Tentative Settlementover North Carolina Plant Fire, Evacuation

EQ Industrial Services and residents of Apex, N.C, who were evacuated following explosions and a fire at the company's hazardous waste facility have reached a proposed $7.5 million settlement, an attorney for the plaintiffs told BNA Oct. 29 (Beaulieu v. EQ Industrial Services Inc., E.D.N.C, No. 5:06-cv-400, motions filed 10/28/08). According to Robert E. Zaytoun, an attorney with the Raleigh-based law firm of Zaytoun & Miller, a motion for preliminary approval of the settlement and a motion for certification of the litigation class were filed Oct. 28 with the U.S. District Court for the Eastern District of North Carolina. The potential class includes about 3,000 households and approximately 500 businesses, he said.
