A federal district court imposed a default judgment against a company June 5 as a sanction for willfully and egregiously misrepresenting to both the court and opposing counsel its historic use of two industrial hazardous substances (1100 West LLC v. RedrnSpot Paint & Varnish Co., S.D. Ind., No. 05-1670, 6/5/09).rnThe U.S. District Court for the Southern District of Indiana ordered that Red Spot Paint & Varnish Co. must pay for all costs associated with cleaning up a contamination plume under a neighboring property as a sanction for discovery abuse, and substantial attorneys' fees and costs incurred by the neighbor in pursuing its Resource Conservation and Recovery Act citizen suit.
