New York Appellate Court Upholds State's Ballast Water Discharge Rule

A New York state appellate court Feb. 4 rejected a challenge to state regulations that were written to control invasive species by restricting ballast water discharges (Port of Oswego Authority v. Grannis, N.Y. App. Div., 3rd Dept., No. 507661, 2/4/10). The ruling by the New York Supreme Court, Appellate Division, Third Judicial Department, upholds a determination by the Environmental Protection Agency in 2008 that ballast discharges from vessels operating in U.S. waters can be regulated through "Vessel General Permits" to prevent harm from invasive species. The court is an intermediate tribunal below the state's highest court, the New York Court of Appeals.
