Sen. John Thune (R-S.D.) has introduced a bill that would prohibit U.S. airlines from participating in the European Union greenhouse gas emissions trading system, which is scheduled to take effect for airlines in January 2012. The European Union Emissions Trading Scheme Prohibition Act (number not yet assigned) is companion legislation to a bill approved Oct. 24 by voice vote in the House (42 ER 2404, 10/28/11). Thune's bill, introduced Dec. 7, would direct the secretary of transportation to prohibit U.S. aircraft operators from participating in the EU emissions trading system. It also would instruct the administrator of the Federal Aviation Administration and other government officials to negotiate or take action to ensure U.S. aviation operators are "held harmless" from an emissions trading scheme imposed by the European Union.
