Los angeles-a federal appeals court rejected a lawsuit filed by environmental groups challenging the emissions credit system used by the South Coast Air Quality Management District to offset new sources of air pollution (Natural Resources Defense Council v. South Coast Air Quality Management District, 9th Cir., No. 09-57064, 6/29/11). The decision comes in a legal battle accusing the air district of using "invalid" emissions offset credits. Affirming a district court decision, the U.S. Court of Appeals for the Ninth Circuit found plaintiffs failed to allege a violation of an Environmental Protection Agency rule or the SCAQMD's portion of the state implementation plan.
