EPA Clarifies Rule on Fugitive Emissions In New Source Review Determinations

The Environmental Protection Agency published an interim rule March 30 clarifying its intent that sources in all industries must account for fugitive emissions when determining whether pollution control upgrades are needed under the Clean Air Act's new source review requirements (76 Fed. Reg. 17,548). In the rule, EPA said it was trying to clear up any confusion in previous regulatory actions staying provisions of a 2008 rule that had that exempted certain industries, including mines, automobile manufacturing plants, and petroleum refineries, from including fugitive emissions under new source review calculations (41 ER 717, 4/2/10).
